  • Public nature: Court proceedings are generally public, meaning that anyone can attend hearings and access court records unless the court seals certain documents for confidentiality reasons.
  • Judge and/or jury: Cases may be decided by a judge (bench trial) or a jury (jury trial), depending on the type of case and the jurisdiction.
  • Legal representation: Parties in litigation typically have legal representation, such as attorneys who advocate on their behalf.
  • Formal rules of evidence: In litigation, strict rules govern the admissibility of evidence, ensuring that only relevant and reliable evidence is presented.

Arbitration: Arbitration is an alternative dispute resolution (ADR) method wherein parties agree to have their dispute settled by an arbitrator or a panel of arbitrators, rather than going through the court system. The decision of the arbitrator(s), known as the arbitral award, is usually binding and enforceable in court.

Key features of arbitration include:

  • Private process: Unlike litigation, arbitration is a private process, and the proceedings are confidential, maintaining the privacy of the parties involved.
  • Party autonomy: Parties can agree on various aspects of the arbitration process, including the choice of arbitrator(s), rules governing the procedure, and the place of arbitration.
  • Flexibility: Arbitration allows parties to tailor the process to suit their needs, which can expedite the resolution compared to the often-lengthy court process.
  • Expertise of arbitrators: Arbitrators are typically chosen based on their expertise in the subject matter of the dispute, ensuring a decision from someone knowledgeable about the issues involved.
  • Limited appeal options: Arbitration awards generally have limited grounds for appeal, making the process more final and less prone to prolonged appeals.

Which method to choose—litigation or arbitration—depends on various factors, including the complexity of the dispute, the desired level of privacy, cost considerations, enforceability, and the willingness of the parties to cooperate with each other during the resolution process. Some contracts may include clauses requiring disputes to be resolved through arbitration, bypassing litigation altogether. In other cases, parties may opt for litigation if they believe that the court system will better serve their interests.
